Law cannot replace the thing it serves.

Bush is asking for NSA court cases to be dismissed based on a 4 day old unconstitutional law. This law is not the final authority of the land. If it fails to represent the will of the American people it is to be stricken from the books, or used as interpreted properly.

Redress of greivances is a fundamental concern of government and a 1st amendment right of every human and American. The 1st amendment applies to the right to have court cases. As does seeing the person charging you, a 4th amendment right.
